Please carefully review these Terms and Conditions for Transaction (“Terms”“Agreement”) before engaging in transactions, and using the platform and services offered by Outshifter AS. The Agreement sets out the terms and conditions for the transaction and your use of the platform, outshifter.com, including any subdomains thereof, and services (hereinafter collectively referred to as the “Outshifter Platform” or “Platform”) offered by Outshifter AS. By using, transacting, accessing, or registering for the Outshifter Platform you agree to comply with and accept these Terms.

When these Terms mention “we,” “us,” and “Outshifter” it refers to Outshifter AS. Outshifter AS is a limited liability company registered in Norway under the company registration number: 917648972 and address: Nes Terrasse 33, 1394 Nesbru, Norway. This agreement is between you and Outshifter AS.

For information about our collection and use of personal information in connection with your transaction, access to and/or use of the Outshifter Platform, please see our Privacy Policy.

This Agreement is always available on the Outshifter Platform.

  • 1. Formation of Contract & Order Confirmation

    1.1 When you order products and services through Outshifter you have a contract with us as stated in these Terms as well as a contract with the Supplier you are buying the products or services from.

    1.2 When clicking “Buy Now” you place an order. You will receive an acknowledgement e-mail to the provided email address confirming the receipt of your order and details. All orders are subject to availability and confirmation of the order price. Your order is only accepted once payment has been approved. The order is fulfilled by the Supplier you are buying the products or services from.

  • 2. Shipping, Returns, Customs and Cancelations

    2.1 The shipping and order fulfillment is carried out by the Supplier and their shipping provider. The Supplier is the responsible party for the shipping costs. These costs are clearly stated in the Order Total at checkout. Please contact the Supplier for details as it relates to order status and shipping.

    2.2 When ordering products and services from outside of your residing territory you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you; Outshifter has no control over these charges. Customs policies vary from country to country, so you should contact your local customs office for further information. It is your responsibility to comply with all laws and regulations of the country in which you are receiving the products.

    2.3 For the return policy and return of a product you should contact the Supplier you have purchased said item from directly. Information regarding how to contact the Supplier and the return policy is available at checkout and in your Order Confirmation. Return information and labels should also be included with the shipped order. Please be aware that various Suppliers have different return policies and standards for the return of a product. We encourage you to familiarize yourself with the Supplier´s return policy before making a purchase.

    2.4 Cancelations should be done directly through the Supplier and with a copy to Us. Please see the Supplier´s return policy for more details on how to proceed for said Supplier. In addition to this please send a cancelations e-mail to support@outshifter.com with the order confirmation number and order details.

    2.5 Any refunds are paid out to the account or credit card you used for payment. We strive to pay back the refund within 14 days of a cancelled order or refund.

  • 3. Payments

    3.1 Payment processing handled by the Outshifter Platform is handled by MANGOPAY S.A. (Mangopay S.A., 59 Boulevard Royal, 2449 Luxembourg) and are subject to MANGOPAY´s “General Conditions of Use of Electronic Money”“General Conditions of Use for the Payment Services” and “Confidentiality Policy”, collectively referred to as the “MANGOPAY Services Agreement”.

    By making a purchase through the Outshifter platform you agree to be bound by the MANGOPAY Services Agreement. As a condition of Outshifter enabling payment processing services through MANGOPAY, you agree to provide Outhshifter accurate and complete information about you and/or your business, and you authorize Outshifter to share this information and transaction information related to your use of the payment processing services provided by MANGOPAY.

    3.2 All prices are including VAT (where applicable). Shipping prices are estimates and may vary slightly from provider to provider.

  • 4. The Scope of the Outshifter Platform

    4.1 The Purchase Agreement is between you and the Supplier. Outshifter is simply an online distribution software that helps the Supplier facilitate sales, online distribution and transactions. Information about the Supplier is available as you check-out and in your order confirmation. They are responsible for shipping, order fulfillment, returns, cancelations, reclamations, complaints and product recalls. Communication regarding the sale has to be direct with the Supplier. Outshifter is at no point liable for the delivery or return of any kind of goods.

    4.2 Outshifter is not the manufacturer, handler, seller, distributor, designer, or producer of the products and services sold and listed through our Platform. Outshifter simply allows for outshifting to take place. While we work to ensure that product and service information appearing on product listings through our platform is correct, we cannot guarantee the accuracy of such listings. All product and services listed on the Outshifter Platform are User created. We do not endorse, guarantee, authenticate, represent, or otherwise approve of any of the products and services listed on the Outhsifter Platform, nor their description and presentation. Users are responsible for writing product and service descriptions and their sales policies. Thus, we encourage you to exercise caution before purchasing. Please always read labels, warnings and directions provided with the product and service before use. Outshifter accepts no liability for inaccuracies or misstatements about products and services provided by our Users and Third-Parties.
